These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and WISH Education (“Platform”, “we”, “us”, or “our”), a brand of Swisspay Technologies Private Limited (CIN: U66190TS2026PTC218740), governing access to and use of the website wisheducation.in, related applications, content, courses, services, and checkout flows (collectively, the “Services”).

By accessing, browsing, registering on, purchasing through, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the Services.

These Terms are intended for use in connection with the Platform operating from India and transactions denominated in Indian Rupees (INR), unless otherwise stated at the point of purchase. The operator of the Services is Swisspay Technologies Private Limited. Governing law is the laws of India, and courts at Hyderabad, Telangana shall have jurisdiction, subject to mandatory consumer protections. This document is not a substitute for independent legal advice.

1. Eligibility and capacity

1. You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account, make a purchase, or enter into these Terms.
2. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. You represent that all information you provide is accurate, complete, and current, and that you will promptly update it if it changes.

2. Nature of the Platform

1. WISH Education provides online educational content, course listings, learning interfaces, and related digital services. Unless expressly stated in writing for a specific offering, the Platform does not award university degrees, government-recognised certifications, job placements, or regulated professional licences.
2. Course descriptions, outcomes, and skill claims are informational. We do not guarantee employment, income, examination results, admission outcomes, or any specific career result.
3. Certain environments may operate in demonstration, showcase, or mock-payment mode for testing, category licensing, or gateway evaluation. In such modes, payments may be simulated and do not constitute real money settlement unless a live payment gateway is expressly enabled and a successful charge is verified.

3. Account registration and security

1. Where authentication is enabled, you must register with a valid email address and maintain the confidentiality of your credentials.
2. You are solely responsible for all activity under your account. Notify us immediately at support@wisheducation.in of any unauthorised use.
3. We may suspend, restrict, or terminate accounts that we reasonably believe are compromised, abusive, fraudulent, or in breach of these Terms, without prior notice where necessary to protect the Platform or other users.
4. You must not share login credentials, create accounts by automated means, or impersonate any person or entity.

4. Course access, locking, and enrolment

1. By default, paid course lessons and media are locked. Access is granted only after successful payment verification and creation of a valid enrolment record.
2. Frontend messages, browser storage, or local device changes do not constitute authorisation. Server-side / platform verification is the source of truth for unlocking content.
3. Enrolment grants a limited, personal, non-exclusive, non-transferable, non-sublicensable licence to access the purchased course for your own lawful learning use, subject to these Terms.
4. We may revoke access where payment is reversed, charged back, refunded, found fraudulent, or where you materially breach these Terms.
5. Access duration, if any, is as stated at purchase or in the applicable course terms. Silence does not imply perpetual rights beyond what is expressly granted.

5. Fees, payments, and taxes

1. Prices are displayed in INR unless otherwise indicated. Applicable taxes, if any, may be added as required by law or as shown at checkout.
2. You authorise the selected payment method / provider to process amounts due. You are responsible for ensuring sufficient funds and accurate payment details.
3. Orders remain pending until payment is verified. We may cancel unpaid, failed, or suspected fraudulent orders.
4. Mock or test checkouts are for demonstration only and create no entitlement to real-world refunds of money that was never charged.
5. Chargebacks initiated without first contacting support, or initiated in bad faith, may result in immediate suspension of access and account review.

6. Refunds

Refund eligibility, windows, and procedures are governed by our Refund Policy. Where that policy and these Terms conflict on refunds, the Refund Policy controls for refund matters. We reserve the right to refuse refunds where content has been substantially accessed, downloaded, copied, shared, or abused, or where fraud is suspected.

7. Acceptable use — strictly prohibited conduct

You must not, and must not attempt to:

• Copy, download (except where explicitly permitted), record, rip, scrape, mirror, redistribute, resell, sublicense, or publicly perform Platform content without prior written consent;
• Share purchased course access with others, operate “account sharing”, or create derivative commercial training products from our materials;
• Circumvent DRM, access controls, paywalls, enrolment locks, or technical protection measures;
• Reverse engineer, decompile, or probe the Services except to the limited extent permitted by applicable law that cannot be waived;
• Upload malware, spam, unlawful content, or content that infringes third-party rights;
• Harass users or staff, or use the Services for illegal, fraudulent, or deceptive purposes;
• Misrepresent affiliation with WISH Education, or invent false claims of accreditation, partnerships, or guarantees on our behalf;
• Use bots, crawlers, or automated extraction in a manner that overloads or harms the Platform.

Violation may result in immediate termination, content access revocation, and, where appropriate, legal action and recovery of damages, costs, and enforcement expenses.

8. Intellectual property

1. All Platform branding, logos, UI, text, graphics, course structures, lesson materials, videos, and software are owned by WISH Education or its licensors and are protected by applicable intellectual property laws.
2. Except for the limited licence in Section 4, no rights are granted by implication or estoppel. All rights not expressly granted are reserved.
3. You must not remove proprietary notices or use our marks in a way that suggests endorsement without written permission.
4. Third-party media, trademarks, or linked resources remain the property of their respective owners. Presence on the Platform does not transfer those rights to you.

9. User submissions

1. If you submit messages via contact forms or other inputs, you grant us a worldwide, royalty-free licence to use that content solely to operate, respond to, and improve the Services, and to comply with law.
2. You represent that your submissions do not violate any law or third-party rights and do not contain confidential information of others without authorisation.

10. Third-party services

The Services may integrate authentication, hosting, analytics, storage, video delivery, and payment providers. Your use of those services may be subject to their terms. We are not responsible for third-party outages, policy changes, or acts outside our reasonable control, except as required by non-waivable law.

11. Disclaimers

1. THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
2. We do not warrant uninterrupted, error-free, or fully secure operation, or that defects will be corrected.
3. Educational content may become outdated. You are responsible for independently verifying information before relying on it for professional, legal, financial, or safety-critical decisions.

12. Limitation of liability

1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WISH EDUCATION AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
2. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SPECIFIC COURSE OR SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRECEDING THE EVENT, OR INR 1,000, WHICHEVER IS HIGHER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
3. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

13. Indemnity

You agree to indemnify, defend, and hold harmless WISH Education and its operators, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your misuse of the Services, your breach of these Terms, your violation of law or third-party rights, or your unauthorised sharing or redistribution of content.

14. Suspension and termination

1. You may stop using the Services at any time. Account closure requests may be sent to support@wisheducation.in.
2. We may suspend or terminate access immediately for breach, fraud risk, legal compliance, or Platform integrity reasons.
3. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) shall survive termination.

15. Changes to the Services or Terms

We may modify the Services and these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use after changes constitutes acceptance, except where mandatory law requires additional consent. If you do not agree, you must discontinue use.

16. Governing law and disputes

1. These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a different governing law is mandatorily required.
2. Subject to applicable consumer protection rights that cannot be waived, courts at the place of the Platform operator’s primary business operations in India shall have exclusive jurisdiction over disputes arising from these Terms.
3. Before filing a formal dispute, you agree to contact support@wisheducation.in and attempt good-faith resolution within thirty (30) days.

17. Miscellaneous

1. If any provision is held unenforceable, the remaining provisions remain in full force.
2. Failure to enforce a provision is not a waiver of the right to enforce it later.
3. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement regarding the Services and supersede prior conflicting communications on the same subject.
4. You may not assign these Terms without our prior written consent. We may assign them in connection with a reorganisation, merger, or transfer of the Platform.
